Essay Instructions: Compare the structure of the government in the Articles of Confederation with the Constitution. What were the weakness in the Articles that led to a call for a new constitution? What sections of the Articles give clues to its structure and purpose? How did the new Constitution address these weaknesses? Provide specific examples and details about the Constitution that address the weaknesses in the Articles. Details from Article I, Section 8 of the Constitution provides some examples of these changes. Your paper should also address the underlying principles of the Constitution discussed in the assigned reading from the Epstein and Walker text book Describe these and give examples of where and how they are found in the Constitution. Again, detail is important. The final paragraph (or two) of the paper should explain what you learn about the theory and structure of the Constitution from having compared it with the Articles of Confederation. Your paper should be four to six pages. It should be written in Word (as should all papers for this course), double spaced, 12 font, about 300 words per page and thus a minimum total of 1,200 words not including name, title, references etc. Check your word count before submitting your paper. This, and all papers prepared for this course, should be written entirely in your own words. Do not quote from the text book or other sources.
The
continental Congress adopted the articles of Confederation, which were finally
approved by all thirteen states. Based on the Articles, the structure of the
national government consisted of a one-house legislature commonly referred to
as the confederation congress; there was neither judiciary nor national
executive. Whereas each state had one vote, the delegates to the confederation
congress were appointed by the state legislatures. This Congress had the full
power and authority to develop state policies, run the post office, appoint
army and navy officers, declare war, regulate Native American territorial
affairs, and coin money by legal approaches. While it has been crucial to refer
to the Articles of Confederation for governance, it is convenient to compare
the Articles, highlighting the weaknesses found in the articles of
Confederation that led to the establishment of the new constitution, outline how
the new constitution addressed the weaknesses, specify the underlying
principles of the constitution, and explaining what is learned about the theory
and structure of the constitution.
