A group of students held a
meeting in the home of one Christopher Eckhardt, planning to publicly show
their support for an agreement in the Vietnam War. They agreed to wear black
armbands, but the school principal learned of the plan and developed a policy
prohibiting anyone from wearing them (Tinker v. Des Moines, n.d). The policy
required students to refrain from wearing the armbands or will be asked to
remove them with resistance-attracting suspension. On a later date, Mary Tinker
and Eckhardt wore the armbands to school but were suspended. John Thinker also
did the same and was also suspended. Through their parents, the three students
sued the school for violating their rights to expression and sought court
intervention to prevent the school from disciplining them. The issue of the
case is the student`s right to expression. The district court dismissed the
case and upheld that the school had the authority to maintain discipline among
the students. The U.S. Court of Appeals also affirmed the decision without
giving any opinion on the case.
