James Gargasoulas' case is
very conflicting to the public and to judges that made decisions on his fate
after his multiple crimes. Particularly, he was charged to have run into
multiple passengers on Bourne Street on multiple occasions, resulting in death,
the fate of mild consequences on their health. The conflict arising from this
case results from his difficult childhood, which may have influenced conditions
that he has developed as an adult, that may have caused the tendencies he may
have that inflict harm to the people around him. For instance, his parents
divorced when he was two years old, his father was abusive to him and his
brother, and he dropped out of school at 12. Jason’s defense presents a
difficult life he has lived through, including the fact that he is a father to
five children with different women. The major consideration before judgment was
Jason's mental condition when these adverse effects were evident and the
influence on his psychotic behavior while also ensuring citizens' safety since
Jason was a threat to society. His paranoid schizophrenia had, however, not
developed until he was already a threat to society by running over citizens on
the streets, so it could not be an adequate excuse for his behavior.
Considering his citizenship rights that ensure his safety and mental wellbeing,
his case received a judgment that may have appeared punitive. The court’s
decision reflected the principles of punishment and rehabilitation of Jason,
where factors considered included his lack of empathy and remorse for the
crimes he has committed and his mental health, which would necessitate
receiving professional help. Life imprisonment and mental healthcare where the
final decisions, which in public sight and the consideration of the law seemed
fair.
